PEI Legal Aid uses a mixed model for service delivery. The majority of cases are handled by staff lawyers. Cases are referred to private sector lawyers only where staff lawyers are unable to act because of case conflicts or scheduling reasons.

Family law coverage is categorized on two levels. The levels are based on the urgency and seriousness of the applicant’s legal needs.

Level One Coverage is provided where the personal security of the applicant and/or dependant children is an immediate and serious concern.

Level Two Coverage is focused on serious legal needs including custody, access, financial support or shelter issues where domestic violence and the security of the applicant are not of immediate concern.

Divorce coverage is provided only where it is considered the most effective procedure of addressing one or more of the foregoing objectives.

Legal Aid is available for Child Protection matters at all stages of legal proceedings under the Child Protection Act.

Most legal services are free of charge to eligible applicants. Applicants may be asked to cover some costs such as disbursements, fees for document production and service, witness fees, and reports by experts and consultants.

Governing legislation/legislative authority
Prince Edward Island does not have specific legal aid legislation. The program is operated under the general powers of the Office of the Attorney General.
